Scammed?

Well recently I was scammed by a guy who lives in Florida. I lived about 2 1/2 hours away from the guy and I was buying a flats account from him via Craigslist.

Since I didn't have the time to drive to him I WU the cash and I figured I could trust this guy… Well after he rushed me to send payment, I didn't hear back from him for days.

Finally I called my local Police Department, I filed a information police report. I then called over to the Gainesville police department. I filed another police report, the officer had me send over all the proof I had–ie; WU paperwork, text screen shots, email convos, etc.

That was about 3 weeks ago… Finally yesterday around 3:30-4:00 I received a call from the major case criminal investigation of Online Fraud department… The Detective has taken my case and I just received a email from the detective today….He said hes waiting on a couple of subpoenas to come in from Facebook / Craigslist and the next step is for him to talk to Jeffrey Bjorkman to see what his story is.

I explained to the detective yesterday with what I was buying and I kind of expected the guy to laugh but he said " This is a serious matter, just because its a game; its still fraud–he lied to get you to send you money "

Call me crazy if you think I am taking this to far and I understand this happens every day to a lot of people but if he's breaking the law don't you think he should have to face his charges like a man? Hell he changed his phone number too, I have his address but what good does that do for me?

Well you could pull a nice stunt on him…I'd probably do it. Go salt his lawn or something LOL. Nah, kidding.

But yeah, don't use WU if you're not 100% sure of something. I'll never use WU personally. At least if you would have sent it via PayPal you could file a dispute, with WU once you send it, it's gone and you aren't getting it back.

I suggest informing him about the current situation he is presently in. He obviously isn't some world-class criminal because he was scared off his ass once he con-ned you (up to the point where he changed his phone numbers). If he is sane he will contact you back begging for your forgiveness and offering to make a deal. This is the point where you make your decision, but to get to this point you have to take the aforementioned path.

My two cents.

Wow… how hard would a choice like that be. Put yourself in that guy's shoes. The guy is probably broke looking to make some quick cash to float his next rent payment. I don't know how much he got from you, but I think you should cut this guy some slack when you make your decision. Make a deal on some money (good chunk more than you were scammed) and tell him he's never going to scam someone again. I don't care if that was his background but give him the benefit of the doubt.

If you decide to put him in jail- or even a criminal record, you are ruining his life forever. He won't be able to get insurance for any kind of decent price. He won't be able to get a job anywhere that provides substantial living wages. He will have to check up with police for the years to come. He will have his internet activity monitored for life. He won’t be able to buy a house (not that his job will allow it either). Have some sort of kindness… let the man live past his mistakes. Have the forgiveness of God.

I hear you all criticizing this man and saying that he should be punished and put in jail, but you don't realize how devastating that will be for this man. None of you have any idea how hard it is to go to jail, or how hard it is to stand up in front of a judge and confess your wrongs, how hard it is to live with what you did and the immense consequences that followed- YouTube it, Google it; you’ll get the same results about how hard all of the process and the system are/were. I actually quite pity this man right now because of all of you- none of you have any right to be pointing the finger at a man you don’t even know, you should all be ashamed of yourselves. What he did was wrong, but nobody is perfect. Please just give it some time and thought before you seal this man's fate…

Joe - I'm not sure at what point in time I should give him any bit of help. If he needed the money for rent, then get a job… Junkies have a addition and they rob, lie etc to get money but are we suppose to feel sorry for them?

I have tried to work out a deal with him, I've left him a few text messages not sure what he received since he changed his phone number. That being said I have also emailed him 3 times and he's ignored it.

If you think for one second when the detective goes to arrest him I'll grant him any bit of kindness to work a deal he's dead wrong.

If he thinks he can get away with it he wont give me my money back, but yet when he finds out hes going to go to jail he's willing to give my money back? Ironic dont you think? I'm going to see to it that he's arrested; I've wasted enough time and now the detective is investing the case so he's now has time invested into this so the state will make the final judment call with what they intend to do.

flats are usually upwards of $300, am I right? You really had a good deal going on, and you didn't see this as too good to be true? The account must have been stripped clean with nothing but holiday gear for it to be remotely close to $150…

This guy probably has scammed more people. He probably prays on the trust of others. This is not a joke. Stealing is stealing. Doesnt matter how much money. He thinks he can get away with this and next time steals even more. The law is the law, and this guy is breaking it.

He broke the law, no matter what reason. He deserves any punishment he gets, unless it's just too extreme.

po2n doesn't have the authority to put him into jail, he can only press charges. It's up to the judicial system to determine if he gets jail time or not. Even if he does get put into jail, he broke the law and took the risk. He can only blame himself for ruining his life.

If someone decides to do something against the law and gets caught, they brought the punishment upon themselves. They'll have to live with that mistake for the rest of their life, not anyone else.

That is what the detective told me. Fraud via a virtual game or Fraud over selling someone something via ebay, etc…Doesn't matter.

And this is what fraud means:

Fraud: Wrongful or criminal deception intended to result in financial or personal gain.

Fraud: A person or thing intended to deceive others, typically by unjustifiably claiming or being credited with accomplishments or qualities.

Im not trying to justifiy what this person did because it is obviously wrong, that is black and white. However depeneding on how this situation would be handeled in court as stated above by joe u could be in effect altering this persons life forever. I mean my father owns many businesses and giveing this person a criminal record of this magnitude can deny them a extremely large portion of jobs avaiable, even after thier jail time and fines. Haveing said all this it is ulitmatly your decision and I completely support u in either choice, and this person has still broken the law and u are the victim, im just trying to state that this is much more than simply wining one for honest internet salesmen and ruining scammers. This person could be on either end of the spectrum, well off person evily scamming children, or father trying to help his family survive. This is a sersious situation.

I just received a email from the detective this morning.

He said hes still waiting on Facebook's records (Not sure why though)
He's going to call Jeffrey Bjorkman later this week; he's going to approach it from " provide the product or give him back his money" angle.

Once he confirms that Jeffrey Bjorkman accepts giving the money back or product we can then discuss charges.

I responded back to the detective this morning that its long past getting back my money or the merchandise. Its now about right an wrong and if Mr. Bjorkman thinks he'll get away with it he will. Hence the fact he changed his phone #

Now that he thinks he may go to jail he wants to give back my money? What about all the other people he may have done this to…Or what about the fact he can do this to someone again, he isn't going to stop. He'll just say " oh man I better be more careful next time around to not get caught "

Sadly this time; I'm just going to see to it that he's arrested. I am looking to prove a point and when he's in his the holding cell @ the county jail and he's with career repeat offenders and there all discussing why they were locked up…I'll pay to hear Bjorkman say " I scammed someone for 200$ for a online video game " Boy oh boy…..

I applaud you for standing behind what is right and fighting for justice. I don't care what the crime is if a person chooses to commit it there are consequences, this is real life. Think about your actions as you are the one that's going to be living with them.

However, $150 is going to fall under minor fraud in court right? Probably won't "ruin" any chance of him getting a job. He will just have a fair bit of explaining to do at future interviews.

Sadly there isn't a such thing as minor fraud… Fraud is fraud, fraud of 5million dollars are treated the same as those who do 50.00 dollars…

Its the amount of accounts that adds a bit of jail time…You know the insurance scams that are typically a permanent scam which involves thousands… Those would be the ones that have a long sentence.

Right now the charges the detective are looking at are; scheme to defraud //

its CHAPTER 817.034 which technically means:
The Legislature recognizes that schemes to defraud have proliferated in the United States in recent years and that many operators of schemes to defraud use communications technology to solicit victims and thereby conceal their identities and overcome a victim’s normal resistance to sales pressure by delivering a personalized sales message.

Also for those who think its crazy to be arrested over a game…Let me show you where he's breaking the law;

“Property” means anything of value, and includes:
Tangible or intangible personal property, including rights, privileges, interests, and claims; and Services

“Scheme to defraud” means a systematic, ongoing course of conduct with intent to defraud one or more persons, or with intent to obtain property from one or more persons by false or fraudulent pretenses, representations, or promises or willful misrepresentations of a future act.

If the amount of property obtained has an aggregate value of less than $20,000, the violator is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Technically speaking fraud is based at under 20,000 or above 20,000 - 50,000 is second degree and 1st degree is 50,000 or greater…

Thanks guys I'll edit the first post with some photos of the email from the detective, all the research I have done to get where I am right now with my case.

I'll post some useful tips and advice the detective gave to me for others who may be in my shoes or may one day be in my shoes.

I'll post some of the proof that I have with the Bjorkman case along with his facebook link, address, Drivers License info etc.

In advance all this info in public records, address, drivers license, facebook, email.

Not breaking any privacy laws in advance for the forum.

On a side note; once he is arrested I am going to take his mug shot & drop it into photoshop create a really great flyer that says " SCAM ARTIST ARRESTED "

I've already paint Vista Print for 2k flyers of like the old western "WANTED" poster style and I am using a photo of Jeffrey Bjorkman from facebook and I have his address, height, guessed his weight, hair color, and email / facebook on the flyer saying " Scammer wanted " I am right now looking for someone in Gainesville that I can pay a flate rate to post all the posters around town. I've decided to post them up with in his zip code area and all major shopping centers around his area….

I'm currently also looking for his place of employment in the area to go pay a visit to.

He's a mall cop or some such like that. I know its near a publix shopping center because he said there located in the same plaza the day I sent my Western Union to him….Its not a huge town so I am sure I'll find it.

I'm very persistent and I figured while the detective builds his case I'll smoke him out of his hiding spot… I figured when he see's the signs around town its shoving his face in the pile of shit he created… Nobody wants to see their mistakes.

I know you're pissed off, but if things go through and he is arrested, he will get what he deserves.

Going too far may infact hinder a case against him. They could portray you as some crazy guy who just wants to embarasse this "honest" mall cop. I dunno, it could happen.

I know for sure he'll look like a dirt bag for a few days, hes only 20 or 21 years old. He'll get over it.
