i was riding back from a Bowling alley from shooting pool there, leaving at 1:20am-ishh, and we was taking a back road home.. and a deer jumped out in front of us causing him to jerk the wheel and we flew off of a bank.. the back end(where me and my brother sat), slapped 2 trees causing us to turn 180 degrees in mid air and the car landing in a creek type thingy… thought my brother was dead, when my eyes opened i looked over at my brother, blood was pouring down his face and down his arms.. he wasn't moving.. i couldnt breathe at the moment, the driver was already out and his girlfriend, the driver had the passenger door open screaming/crying telling me not to leave him, because i couldn't breathe at the moment and i was trying to tell him that, and almost blacked out but he grabbed my arm trying to help me out, i thought i was fine but when i touched the ground i fell down, he picked me up and carried me up the bank and sat me there…. i was crying thinking my brother was dead.. my head was gashed in the back.. i called 911 screaming and they got there within 5 minutes, my brother was carried to the top and we both was put in the same ambulance… he woke up asking where we were, was his face bleeding, was he bleeding at all… we both left the hospital okay-ish… as he has stitches in his face, and on his arm.. but i still can barely breathe with my lungs bruised because the seat belt.. and i have 2 staples in my head, and just one stitch in my back(i don't see why they did it)…
BUT….. do you think they should be charging my friend with driving left of center?
Charged for trying to avoid a deer? Did I understand this correctly?

wow crazy story. see the issue with the driver is that watever he decided to do, it would have resulted in a wreck. deer are huge and can really damage a car if hit, and it can easily create a bad wreck. just think if you hit the deer, then fell off the side. :/ right now it comes down the the letter of the law vs the spirit of the law. i personally think he was made to choose between 2 terrible choices, and shouldnt be held responsible for that. yes, technically he broke the law, but i still couldnt ever convict him of it if i were in the jury.

In Europe you wouldn't get a fine for that. You're not responsible for the actions of a deer. Evading them is in most cases the best option, hitting them can also kill the driver. Also it is not a choice to avoid hitting the deer, it is a reaction. I can't believe that anywhere on this world you will get a fine for that.

the law doesn't believe us though… i guess because the "black marks" that ran across the road into the left lane then into the bank……. im thinking about having it as superior court because i will go against the law… law is nothing but crooks..

Actually.. the black marks from a physics perspective tell the story of what really happened.. Scientifically that is.. I did all that crap in Mech. Engineering and Physics & Dynamics class..
I'm pretty sure if the evidence or tire skid marks were left there and forensics look into it, he'd be convicted.. Only time he wouldn't is if the Jury has sympathy.. in this case they shouldn't really convict him.
I believe most of the jury would think that if you had enough time to turn off to the left, you'd have enough time to stop the car or at least slow it down drastically.. or at least turn back to the right or something after dodging the deer.
WTF is wrong with America. Thanks god I don't live there.

we was going around a sharp curve when he seen the deer he jerked the wheel slamming the breaks, but when we hit the grass we had no control..

Sounds familiar. I went to unplug my gps a few months ago… Hit a tree and broke my neck
Only got out of the neck brace less than a week ago lol.
Still don't have full rotation, but can drive again soon =]

I know the new law or whatever is to not "veer" for deer - animals in general. I usually just slow down if I can, but its different when you just 'react' in a split second.

I'd say it would depend very much on how fast you were traveling. The logical reaction for anything sudden like this would be a quick swerve as opposed to slamming the breaks.
Terribly sorry about the accident in any case. I hope you both recover fine. :)
