the amount this Order required Defendants to pay Jagex for its damages and
attorneys’ fees was in excess of “six figures.”

Ouch.

Kyle Undefined

They also have to provide a DB of all the people who paid for or worked on the bot. Wow.

Throughout the course of this lawsuit, we've come to understand the harm that botting does to RuneScape and Jagex.

…it took them that long to realize that mass botting was bad for the game and the company?

Still, the verdict seems unnecessarily harsh.

No need to SSRL it anymore. Docets posted at sythe etc.

Ouch that hurts!!
Can't this same thing happen to dankness for example? I mean, he's still hosting/developing the site right? (Or is it in hands of fakawi/wizzup?)

Nothing illegal? Hosting a site about RS Botting with tens of thousands of registered users. You find tons of tutorials & scripts especially designed to bot at RS.

We don't deob their client and make money from doing it, which is what they were being sued for.

But it's still illegal..a forum with scripts to cheat at RS, site with RS Gold selling ads, scripts that have impact on RS community/GE,..

I know lots of people think we aren't doing anything illegal, but is that really true?

Kyle Undefined

2012-01-20 14:22:58

We don't make the ads, that's what Google serves. It's all based on your search/visit history.

It's not our scripts impacting RS, it's the gold farmers. They are the ones who hurt RS, because auto'ing a few hours a day doesn't have an impact.

Yes, we are breaking their ToS, but illegal, I don't see it.

You're right about the ads, but I dunno about the rest though.
I just hope Wizzup & Fakawi wont have the same problem in the future as those 2 have.

No indeed you can't get a law suit about cheating on RS, but still :s
I just hope that their lawyers wont find anything to sue Fawki/Wizzy, that's all I'm saying.

Btw in NL most of the bullshit that applies in the US, does not.

Tell me, what's illegal about SRL. That we use the name Runescape to reference to their game? Ok, if they gonna bitch about that we could censor that out (no judge in NL would find it reasonable not to give a call/letter about that first).
SMART loads RS just like a regular browser and doesn't do anything special besides that (ok, it hijacks the canvas but it's not illegal to hijack the canvas). If pressing the S key when loading the client is breaking encryption, well then it would be illegal. I doubt it is. Considering that CSS (of DVDs) is ineffective and thus legal to break (in Finland, but Dutch law is similar due to EU directives. As said in the article, it might not set a precedent but there are no other rulings about anything like this).
SRL contains some bitmaps of symbols and such. Those are (at most) 8x8 pixels. Again, if Jagex would not want that they should send a letter 'gtfo with those symbols' first. We could work around them. DTMs are so meaningless without context that those should be safe (those 5 points could be anything).
The final thing is fonts. We distribute them and that might not be too nice. Again, we fonts we have now are mostly auto-generated from the RS cache. If they whine, we could just ask people to generate them themselves.
Is botting software illegal? I have no idea. (Mass) botting itself might be illegal because it might damage Jagex' income, but I don't think that just botting a bit at your main (so you get higher levels and enjoy the game more) damages Jagex but the opposite. As autoing at mains happens quite a bit, Simba/SRL has multiple purposes and not a sole (if mass botting is illegal) illegal one.
I'd love to get a few law students working on this one, problem is that all I know are either too stupid to understand this or hardly started their education.

TL;DR nothing to worry about for now.

Edit: It's obvious Simba is 100% fine as it has almost nothing to do with RS. It's SRL (include) that might be messed up a bit.

Lol true. Good luck to any Jagex lawyer who wants to sue me for botting, 80-90% of my country cannot speak English, not even the president. :spot: They'll be stuck on arrival alone.

Maybe it is time to advertise these Simba abilities by writing useful scripts, for other purposes besides rs. These projects could function as a showcase on mainpage. As mentioned before, it is time to draw attention to Simba, and away from this board, make this board "officially" a "Simba User" community. But these are my thought in our little exploding minefield.

Selling the scripts seems to be a key issue there, I wonder how big of a case they would have on completely free scripts..

Dear Player,

We have strong evidence that you may have purchased and used botting software in the past, specifically ibot software.

Botting and the cheating it brings is destroying your game, violates Jagex's rights under the Digital Millennium Copyright Act (DMCA), and any player that continues to engage in botting activity has no place in our community.

As part of bot nuke week we are offering you a 1 time amnesty and settlement lifeline, which is a chance to reform and change your ways. We'd like you to contribute to the community in a positive way, to compete on a level playing field as everyone else does and play in the true spirit of the game, with integrity. All of your accounts, main and otherwise, are now on our watch list and will be monitored for the use of ibot and all other inappropriate third-party software. Regardless of who you are or how long you've been with us, if you decide to cheat and bot ever again we will have no hesitation in: (1) permanently removing your account from our wonderful community in order to protect Jagex's rights under the DMCA, and (2) naming you as a defendant in Jagex Limited v. John Does, which is a lawsuit based on DMCA violations that is currently pending in the U.S. District Court for the Central District of California (Civ. Action No. SACV11-00969-CJC).

Please note that this amnesty and settlement offer is protected under Fed. R. Evid. 408. If you ignore our offer and instead continue use botting software, we reserve our rights to pursue statutory damages against you for between $200 to $2,500 per act of past, present, and/or future botting in accordance with 17 U.S.C. 1203©(3).

We do hope you make the morally sound and lawful choice of turning your back on bots. We look forward to seeing you in game having fun in a way that is true to the spirit of fair play and respectful to your fellow players.

Yours sincerely,
Mark Gerhard

yea I've seen some awesome ideas for games that are made inside of simba.. and also some neat scripts like that velocity calculator and other things.

I had a friend make nearly a fully functional script for realm of the mad god, he was learning simba through it.. he made it so he can kill the god monsters or something and get all their items lool (no idea what that game is about) it was pretty cool though he did pretty much all dtm's of the monsters

Holy Crapola. I doubt anyone here knows who I am, but I was part of the RS cheating community a long time ago. I've occasionally checked on what was up with SRL, and I just thought to google ibot to see what they were up to.

I'm surprised that this happened, but I guess when you charge money, shit gets serious.
