Kicked out of school. Pure ridicule.

I have been suspended from school for 2 weeks.

Why ? You may ask, well this is my story.

I was walking home from school when I saw something quite disturbing :

My sister, whom is 9 years old, was being hit by some boys, who apparently (why apparently ? You will find out further down) was 11 years old.

Why would he do that ?!

Because she didn't want to give him her Pokémon cards we had given her for her birthday a month before.

She was crying, I ran to her, pushed one of the boys against the wall and asked what was happening, and noticed her nose was bleeding.
She had a hard time talking to me, she was crying, all I understood was that they wanted her to give them her pokémon cards.

I asked what she would get in return, and she said nothing.

I looked at the boy straight in the eyes and asked him if this was true. He laughed and kicked my sister in the butt.

That pissed me off. I hit him in the stomach with my knee, hit him in the face, and was about to kick him again when an old man pulled me away from him. The other boys ran away.

I went to the police, the same day to explain my behaviour. My parents were there but they could not help me, I had to be alone with the police officers.
They asked my sister who was still crying her version of the story, and finally the boy's story.

Of course his was not the same as mine nor my sister's.

No problem so far huh ?

Then, the real shit :

The boy was the son of the brother of the school board leader (is that the right way to say it ?).

As a result she suspended me from school for 2 weeks for violence against another person.

My parents want to take this to court, but they need my opinion.

I wonder aswell.

Its obvious that they boy started it, but it is aswell that I only made things worse by having an agressive reaction to the problem…

What should I do ?

Considering your sister's nose was already bleeding when you got there and the guy kicked her in the butt, your violent actions were after his, and therefore in defense of your sister. You'd probably have a good case IF you have a medical report of your sister's status at the time, otherwise without any other witnesses there won't be too much you can lay your accusations on.

Hmm, not sure if you should have been so violent, maybe just held him back/stopped him from doing any further harm to you/your sister. But since he did attack her first, I bet you could easily argue that it was all in defense of your sister/self defense. Only think you did wrong IMO was be so rough on him, but I TOTALLY understand you rage, especially in that situation.

Not sure about court stuff, that's quite messy. Talk to a lawyer and see if he thinks you have a winable case, if you do, then go for it.

I think you did good, but maybe went a little over the top with hitting him in the face, I know how much a punch/knee in the stomach can hurt, trust me, I fight with my twin brother all the time.

What you did was just your instict, if someone was to do that to my sister I would have immediately jumped to her defence as well, in my opinion that's just what your instinct tells you to do at a moment like that.

1: Beating up a girl
2: Was your little sister
3: Over a deck of Pokemon cards
4: You were out of school
5: He was 11, your sister was 9

Please, you did the right thing. A guy should never hit a girl, only restrain. You didn't make the best example but you sure did teach the kid a lesson not to hit girls. Especially over a deck of pokemon cards. Seriously? Pokemon cards? 1st generation, I understand. Got 600$ worth of them. But next gen? Come on, bunch of nerds. What did you mean by make it worse? School record? Wasn't the old man a witness? Bloody nose should be medical evidence? Did you check for bruises? This was not an act of violence. This was an act of perfect, non-selfish, protective, big brother-ness. You won the majority story vote (2 > 1).

No. Witnesses would have to be someone who saw, but was not involved (victim or the doer). The old man would have been considered a witness, if he saw the whole thing.

Sorry to hear :( just because that kids uncle is the president of the school board, he shouldn't get special treatment. And also because no witnesses testified, the matter should have been dropped. Yes, I'd say this is wrong, you need to take action imo.

I would guess that you could appeal the decision within the school system without going to a court or hiring a lawyer or anything. There are certain circumstances where schools have "zero tolerance" policies and it can end up creating big consequences for minor things. You should certainly follow up on this, though. There's no reason not to, and you have a very reasonable explanation for what happened. You saw an older boy assaulting your younger sister and intervened. The fact that he assaulted her again by kicking her even after you arrived would justify a physical response as far as I'm concerned.

You need to find out exactly how to appeal this, who to talk to, who is over them, etc. If the principal makes the decision, then you could talk to the school board. If the school board decides, you could take to the superintendent, etc. Take it all the way to the top. And if that doesn't work, then I would even consider taking it to a civil court by suing the school system or the woman that suspended you in her official capacity.

I think you could convince a jury that you were justified in doing what you did, and could possibly win a judgment against the school or the woman.

Shady?

I'd suggest you at least talk to a lawyer about it.

I do know that in my school district, administration can not be held accountable for any of their decisions, you can only sue the district as a whole here =\. Just try to make sure that the end result is your suspension being undone (even if it's after you took the two weeks off, you still don't want it on your permanent record and then you get to make up the homework) and hopefully something being done against the parent, regardless of it's through a lawsuit or an in-district appeal.

FEAR

2009-11-22 02:27:37

You should talk to a lawyer. But I am all for going to court and getting some justice. There is nothing wrong with your behavior. I would have done the same thing if not worse. If you go to court, your sisters nose would be proof enough and that kid isn't smart enough to keep on lying to the questions the lawyer may ask so I know you will win.

But it's up to you I guess. Best thing would be to talk to a lawyer. Don't let this slide. If you do, that kid might do the same thing to someone else or even attack your sister again in the future. He obviously thinks he can get away with whatever he wants.

Good luck and keep us informed about your decision.

You have full right to hit someone if they do that to your sister. The fact still remains that he was 11 and I'm assuming your much older. Now this would piss me off just as much if not more than it did you so i understand what your saying and your actions. You still should have controlled you anger. Also she had almost no right to suspend you, so i think you might have a half-way decent case in court.

Well, if they punished you they should least punish the other kid. Give him 2 weeks as well :). If they are able to give u 2 weeks suspension for beating somone up, they can easily give the other kid 2 weeks suspension for initiating beating the girl up(add details: its a girl, she bleeding, she's younger, etc). School board's head or not, the same law applies throughout.

but of course, it would be more benifical to justification if you post (if you can) your sister's side of the story, and the other guy's side of story… and even their parents side of story.

I would contact the local media if you want to push it further. I'm sure they'd be willing to do a feature about this. It has a lot of appeal, I think.

A young girl with her Pokemon cards from a birthday present being accosted, threatened, and assaulted by a group of older boys. Just that alone would be enough for some news stations to report on it. The fact that you attempted to intercede and ended up being punished just makes it that much more worthy of some media scrutiny. That's the next logical step as far as I'm concerned.

You could always try to cut a deal where you admit no wrongdoing, but accept a 2 week suspension as long as it doesn't go on your record.

If you can't wiggle out of it, I wouldn't worry too much about it. But I know I wouldn't go down without a fight.

Second, the fact that you are suspended for beating him up is just plain stupid. I agree with the others that this would make a funny news segment though. Much better than the usual "boyfriend pours alcohol on girl and burns her" stuff. Plus, it'll annoy the school systems and that jerk kid's uncle! :D

man if it were me, the other guy and whoever it was would probably have wound up in the hospital. but i digress.

i think a 2 week suspension isnt all bad. at least your not getting expelled. (like some other people i know)

i know without a doubt, if it happened anywhere else, you could have landed yourself in Juvenile jail for your actions. I know i know, the situation was intense and you had to do something to protect your sister. In situations like these, people will always tell you shouldn't have hit the other boy, but they probably haven't been in your situation (like i have).

Don't worry about it. The suspension is probably going to stay on your record if you don't take it to court. Though without a second witness and evidence, it would be really difficult to win.

and wtf is up with the school board. did they tell you what happened to the other boy and what his consequences were? If not, you can bring this to court claiming the school board is showing bias for the other boy. You would need a lawyer though… it'd cost some cash if you were going to do it.

If you got punished more than him while your actions were in defense of your sister, you can go to court and win. There is favoritism involved, etc.

If he got punished as much or more than you, then your punition is considered fair, because no form of violence is acceptable according to school standards (IRL it's another can of tuna).

And I don't want to be talking out of my ass, but for such a trivial lawsuit you wouldn't be needing a lawyer in Canada, I don't know about USA.

This kind of crap just makes my blood boil. Anyone would react violently to seeing their little sister getting beat up, especially by an older boy, with others with him. Just cowardly and pathetic in so many ways.. IMHO if you're prepared to start a fight or hit someone you should be prepared to get hit too as a consequence instead of crying to your parents and uncle about it.

But yeah, when it comes to the hitting part in Finland you'd most likely be the guilty one, or atleast you'd face the worse punishment (the kid would most likely just get some fines and whatnot because he's younger and blah blah), and can't really say anything about the school part as I don't know how the school system works around there.. Gl, anyhow, but I wouldn't suggest taking this to the court.

It's always so that when shit happens to you, the law will make sure there's more coming, for example, my friend got beaten up including them hitting his head on the ground by two guys while my other friend fought back a bit, and it just went to uhm… Sovittelu ("agreement")… But for sure if my other friend had knocked the two out cold or something he'd gotten a real punishment…

Wooooo ! Great news !

I'll make it short, well, as short as I can :

The school called me in the afternoon, while I was doing my daily 25 exercises and told me to meet them in the school at once.

I was there, everybody looked at me, wondering why I was here, the teachers didn't want me to talk with them.

I came into the room, my parents, the school board, the boy, and 2 other people were there.

The boy was crying.

They asked me to tell the story again, which I did.

The 2 unknown ones "nodded" (correct ? :S) and the school board leader began by saying : I'm extremely sorry for what has happened". I asked why.

They told me that one of the boys of that little group had apparently admitted everything to his parents, the two unknown ones.

The parents had then called the school to clear up things and the school then arranged this little meeting.

Tonight, me, my sister, and my parents are having a little special dinner :).

I'm so happy, thanks for all the support, I'm so relieved that this is over.

In my eyes, the only ones in this story who got to get a real thank you are :

-The boy who admitted
-The boy's parents
-My family, who backed me up, supported me and trusted me all the way through
-Finally, you SRL, who gave me some hope as well as tips on how to sort this out.

Thanks alot.

Go to court and sue for millions :)

If you are part of the minority, you could take it to court as discrimination, if you are part of the major populous, and the school board leader happens to be another race/nationality/etc. you could take it to court saying he was lashing out because he doesn't like your race.

Wow.. I was away for a bit.. and I just read up on the whole thing… That is seriously messed up… I am an extreme passive > aggressive person. When it comes to me personally, I am beyond a passive individual, however, when it comes to others I will be aggressive on all fronts, especially concerning the well being of family members….
With the board… if you were ever to take it to court, you would have a case… "suing for millions" is would just be ridiculous tho.
CONGRATS on the getting everything straightened out. What is the school going to do on their end to correct the wrongdoing that has gone on? I am happy that your suspension has been lifted. I hope your family meal is enjoyable. Have a nice day.

I think she got what she diserved, and as well as learned a lesson. Don't blindly trust family members.
